General Terms and Conditions
SERVICES
The Cubix Institute of Technology (hereinafter referred to as “Service Provider”) is an international educational institution that aims to provide an up-to-date source of marketable knowledge for IT professionals.
The Service Provider organizes practice-oriented upskilling trainings and other professional events (hereinafter referred to as “Services”) with the help of professionals with many years/decades of experience within the IT industry and with the quality assurance background of market-leading tech companies and renowned universities.
The present General Terms and Conditions (hereinafter referred to as “GTC”) set out the binding terms and conditions of the Service Provider’s free and paid Services available through the Service Provider’s https://cubixedu.com website (hereinafter referred to as “Website”) for all users (hereinafter referred to as “User”).
All content, software, technology, design elements, text elements, graphics, logos, links, animations, videos, illustrations, sound files, images, etc. on the Website are the property of the Service Provider and are protected by copyright.
By making an express declaration during registration or purchase on the Website and by using the Services, an online contract comes into force between the User and the Service Provider, which contract is concluded for an indefinite period.
REGISTRATION
The use of the Services is subject to registration, during which the User chooses to register with an existing Google or Facebook user account or with an e-mail address and a unique password of his/her choice (hereinafter “Registration”).
During Registration, a user account (hereinafter referred to as “User Account”) is created for the User for the purpose of subsequent identification of the User. The Services purchased by the User will be accessible through the User Account.
By registering, the User:
- accepts and agrees to be bound by these Terms and Conditions without any further act;
- declares that it is not restricted in its ability to conclude this contract and that it is not in conflict with any other contracts with third parties;
- declares that, when using the Services, they will comply in particular, but not exclusively, with the laws on intellectual property, copyright and moral rights.
The registered person is solely responsible for the availability of the username and password provided during Registration. The Service Provider shall not be liable for any unauthorized use of the username and password by third parties and for any damages resulting therefrom. The right to use the username and password is non-transferable, and the registered user who logs in is responsible for all actions after logging in and for all consequences arising therefrom, regardless of whether the person who actually logged in was himself or herself or another person using the user’s rights.
The Service Provider and the User shall immediately notify the Service Provider and the User via the e-mail address info@cubixedu.com if they become aware of any unauthorized use of their user privileges by any unauthorized person.
CONTACT
The content on the Website may also provide access to other online interfaces. The Service Provider shall not be liable for any damage resulting from the User’s access to these sites. Before accessing the Website, the User shall ensure that it is secure and that his/her personal data is protected.
The links shared on the Website are not checked in advance, and the Operator is not responsible for any problems arising from the sharing of links, such as the authenticity of the link.
Attention should be paid to the fact that external links may expose Users to danger when using educational material, as their content may be offensive or otherwise dangerous, racist or offensive to their person.
The Website or the educational materials may provide access to websites owned by third parties.
The educational materials may only be used lawfully, not knowing the law does not excuse you.
DATA HANDLING
The Service Provider shall handle the data provided by Users during the Registration and the use of the Services as confidential; it shall disclose it only pursuant to its legal obligation and only to the competent court or authorities.
The Service Provider warrants that the personal data of the Users will be processed in compliance with and in accordance with the laws in force, in particular the laws on the right to information self-determination and freedom of information.
The User is obliged to keep the data provided during the Registration up to date.
Users agree that:
- have their data recorded by the Service Provider for the purposes of keeping a register of registered Users and maintaining contact with them;
- process their data in order to improve the quality of the Services and for the purposes of developing its own business offers and market research activities, but the Service Provider guarantees that in the course of this processing, third parties may only access any market research or business material without the Users’ data being identifiable;
- the Service Provider to use automated systems to establish direct contact with registered persons for its own direct marketing, information, public opinion and market research purposes;
- the Service Provider to send them direct mail for their own direct marketing and information purposes.
In addition, all users of the Service Provider’s Services warrant that the personal data that they have received will be processed in compliance with and in accordance with the applicable laws, in particular the laws on the right to information self-determination and freedom of information.
INFRASTRUCTURE
The Service Provider, in order to provide its services to Users at the highest level, performs regular maintenance of its online interface, which may result in the limitation or suspension of the service. The Service Provider will, at certain intervals, carry out maintenance work, preferably between UTC/GMT 22.00 and 06.00 hours, with a maximum duration of 48 hours per maintenance period. The Service Provider shall not be liable for any damage arising in connection with the maintenance.
In addition to regular maintenance, the Service Provider operates a technical fault reporting service at the following e-mail address: info@cubixedu.com. The Service Provider will record the errors reported to the e-mail address provided and undertakes to rectify them as soon as possible.
The User is responsible for the condition of his/her own hardware and software, their quality for Internet access and their suitability for the use of the service.
The Service Provider shall not be liable for any interruption or interruption of the Service and any damage resulting therefrom, which is caused by technical or infrastructural reasons beyond its control (e.g. power failure, etc.), and which is caused by maintenance work carried out between UTC/GMT 22.00-06.00 hours and during this period.
RIGHT OF MODIFICATION
The Service Provider reserves the right to unilaterally modify the GTC, however, the Service Provider will inform the Users of the modification as soon as possible by means of a notice. The notice may be included in the Service Provider’s online interfaces for this purpose and/or in the newsletter sent by the Service Provider and/or in the e-mail notification sent to the User via the e-mail address provided by the User in his User Account. Following such modification, the use of the Service shall constitute acceptance of the modification of the Contract.
TERMINATION OF CONTRACT
This Agreement shall terminate if the User deletes himself/herself from the registered Users of the Service Provider.
Either Party shall be entitled to terminate this Agreement with immediate effect in the event of a serious breach by the other Party of any of its obligations under these Terms and Conditions. The User shall reimburse the Service Provider for any costs and damages incurred as a result of the User’s breach of this Agreement.
After termination of the Contract, the Service Provider shall not be obliged to provide the User with further access to the educational materials previously purchased by the User.
MIXED PROVISIONS
Duty to cooperate
The Parties shall cooperate with each other through their contact persons during the term of these Terms and Conditions and shall inform each other without delay of any material circumstances affecting this Contract and of any changes thereto.
Waiver of right
The right granted by these Terms and Conditions may be waived only in writing. Failure to enforce any right granted by these Terms and Conditions shall not constitute a waiver.

Entirety, Partial invalidity
These Terms and Conditions incorporate all provisions binding the Parties in relation to the Services of the Service Provider, and upon acceptance of these Terms and Conditions, any prior agreements or representations between the Parties that conflict with the object or purpose of these Terms and Conditions or that prevent the performance of these Terms and Conditions shall cease to have effect.
Should any provision of these Terms and Conditions be or become invalid or ineffective, the validity or effectiveness of the remaining provisions shall not be affected unless the Parties would not have concluded the contract without such provision.
Governing law, competent court
In matters not covered by these Terms and Conditions, the provisions of Hungarian law, in particular Act V of 2013 on the Civil Code and Act LXXVI of 1999 on Copyright shall apply. The Parties undertake to attempt to settle any disputes arising between them amicably. If this does not lead to a result within 30 days of the date of initiation of negotiations by either Party, the Parties submit to the exclusive jurisdiction of the Central District Court of Buda or the Metropolitan Court of Budapest, depending on the value of the dispute, for the settlement of disputes arising from these Terms and Conditions.
Provisions for users
After registration and/or enrollment to a course or event for free of charge or for a certain fee, the User will have access to the given educational materials. The given materials may be available for the User via the Website without any time limitation, unless otherwise provided by the Service Provider. The Service Provider is obliged to inform the User of the conditions of the limited access prior to the purchase.
Responsibility
The User may only use the materials available for watching them online via the Website and the downloadable materials for his/her own purposes, and may not pass them on to a third party, copy, reproduce, make them available to others or play them in the presence of more than one person. The offending User shall be liable for any damage resulting from any infringement of copyright, unless he can prove beyond reasonable doubt that the damage was caused by an external cause beyond his control (e.g. unauthorised access to his profile).
The User is responsible for the User’s account.
The User shall immediately notify the Service Provider if he/she detects access by an unknown person and shall take all security measures. The Service Provider shall not be liable for any damage resulting from failure to comply with these obligations.
You may only use another User’s account with their permission, and the responsibility for this rests with the person who assigned it to you.
Payment
If the User has agreed to pay a fee for an educational material of the Service Provider, the User may pay for the educational material by credit or bank card through the Service Provider’s secure online interface. The User is entitled to view the educational material only if the amount of the payment has been credited to the Service Provider’s account. The Service Provider will issue an invoice for the payment, which will be sent electronically to the User. Delay or failure to issue an invoice shall not constitute a waiver of the fee.
Warranty, Guarantee, Right of withdrawal
The Service Provider draws the Users’ attention to the fact that, due to the digital nature of the educational materials, they cannot be returned, the User has no right of withdrawal. No refunds will be possible under any circumstances after successful payment of the fee, unless otherwise provided by the Service Provider.
In the case of certain Services, the Service Provider provides a money-back guarantee, the terms of which the Service Provider is obliged to inform the User of prior to the purchase.
